Get yourself a good lawyer. As far as I know Up to 180 days of out of status can be managed. As your case is in removal proceedings, it may further complicate your situation.
Even if you get an Advance Parole, do not use it. Your reentry will have issue. You may send a private message.

My situation is as under : " My case is in removal proceedings for violating H1b status for 3 months due to laid off situation, i am working on H1b now and my labor is approved and I-140 is pending, now my priority date is become current for I-485 filing", now who will adjudicate my case, INS or EOIR court, where will i file my I-485.
will court close my removal proceedings based on PD current..

My friend got GC when he was single. Later he got married . So spouse is still in India . She has not received GC. She has no visa to visit him.
That is the reason H1B option is being explored. She has the right qualifications and relevant experience. US Corporation is willing to sponser her H1B petition.
Since her husband is already in USA and green card holder, visa officer might reject her H1B petition stating that she is an intended immigrant.
or
he might issue the H1B visa because it is a dual intent visa.
So what's the chances of her getting the H1B visa.

Getting the driver's license is not the problem, I know it will come. Problem here is why I cannot drive outside SC for up to 60 days waiting for the DL card? Remember I've to surrender my old SC license. This is serious limitation to my work, e.g. I need to go to Atlanta on 08/19 and I cannot drive there.
In September I will go to Italy, what if I don�t get my DL till then?

This is ridiculous
On Checking the SC dmv site and it is interesting to note that non-citizens are not allowed to renew their license online. I guess this is the result of illegal immigration reform thing which is now a part of so many states along with SC. And I think they are running background checks against the legal status of any non-citizen folks. My take would be that you should consider meeting the senator and explaining the issue. They can basically expedite the process so that you wont have to wait for a long time.

Hi,
I hope, all is well.
I filed my applications for Green Card. I did concurrent filing for I-140 & I-485 applications in September-2007. I got EAD in December-2007 but I-140 case is still pending.
I am working with the company which filed my Green Card but very soon I would resign from them/there as there is no work over there. They would still continue my I-140 case even I resign from there.
I need your help as:
(1) Can I work on 1099 (as I have EAD & I-140 is still pending)?
OR
(2) I need to work on W2 (means: cannot work on 1099) [as I have EAD & I-140 is still pending]?
Please, advise me as soon as possible.

Online application usually warrants a fingerprinting , it's best to apply in paper if that needs to be avoided.

Me and my wife are on EAD and son is US citizen. Have travelled to India 3 times in last 2 years and POE was Newark, New Jersey airport everytime. Latest was March 15, 2009.
Used Advance Parole to enter everytime.
No problem ever. Only required to wait in another room till advance parole is stamped.
this time however they asked questions like profession. how many years in comapny etc. ?

Hi,
My client is a TARP fund received bank.I am planning to go India for 3 weeks in may.My visa expires in Aug09.
I have new H1 extension for 3 years.
--If I go for visa stamping will it be a problem as I am workig for TARP received bank.
--If I don't go for visa stamping and planning to comeback with old visa, will it be a problem at Port Of Entry as my client is TARP received bank and I am on H1B.

We did check that. What we wanted was I.T project manager, but it got classified as CIS Manager.
We cannot change the job from Project manager to Computer systems analysts.
I am going to be promoted as Project manager, so we need to get a PM role.

Internet posts. For the last 2-3 years I have been looking about and this be ball park figure given. Also as you see that there is big variation in this; 1% to 5% is a big difference.
It would be nice, if someone has better idea than this wider range.

I have Canada PR since October 2006. In October this year I will complete 3 years since landing in Canada. The rule to maintain PR is that one should live in Canada for at least 2 years in a 5 year period. Since I have not lived in Canada more that a couple of weeks since landing, will I be allowed to move to Canada after completing 3 years outside Canada or will I be sent back from the border? Has anyone moved to Canada after living outside for more than 3 years since landing? Please advise.

With these kind of contradictory statements they will definitely send you back from the border. back to where i am not sure.

I'm assuming you are Indian like most of us on this site. remember THIS country would be in big trouble with Indians working in all kinds of institutions working in the sciences and IT. Under the "automatic extension of validity at ports-of-entry" provision, an H-IB alien may reenter the U.S. after a trip solely to Canada or Mexico that lasted no more than 30 days, without the need to obtain a new H-IB visa, even if the individual's prior H-IB visa has expired.
H-1B automatic revalidation different than that for F and J nonimmigrants
F and J nonimmigrants can use the automatic revalidation of visa provision not only after a trip to Canada and Mexico, but after a trip to the islands in the Caribbean as well. H-lB travel under this provision is limited to Canada and Mexico only.

Continued validity of H visas after employer change If the H-IB worker has changed employers since first entering the United States and has a valid visa annotated for the previous employer, he or she may reenter the U.S. using that visa, provided he or she presents a valid H-IB approval notice for the new employer upon reentry to the United States.

Prior to July 17,2004, nonimmigrants in H status could apply for a new H visa through the DOS Visa Office in Washington, D.C., but only if they had already obtained one visa abroad in the category being applied for.
